Right of withdrawal

The customer of Lastilograficamilano.it online store acting as a consumer is granted the right of withdrawal from the contract, as provided for by Articles. 64 – 67 of Legislative Decree no. 206/2005, called the Consumer Code.
It should be noted that this right is reserved only for natural persons, i.e. those private consumers who act for purposes unrelated to their profession.

There is no right of withdrawal for legal and natural persons who act, with reference to the purchase contract, in a professional field.
Pursuant to and within the limits of art. 64 of the Consumer Code, the consumer has the right, within 14 working days of receipt of the products purchased, to exercise the right of withdrawal, consisting in the possibility of returning the products received and obtaining a refund of the price paid, without penalty and without the need to specify the reason.
This right applies to all products purchased online on the www.lastilograficamilano.it site, with the exception of limited edition pens or with numbered warranty.
The costs of returning the product are borne by the consumer.

The right of withdrawal is totally lost if the returned product is not intact, due to the absence, for example, of integral elements of the product (box, warranty) or because the product has suffered damage for reasons other than transport from the store to the consumer, not previously reported.

N.B. Engraved pens or limited edition pens can only be replaced due to defects in form or manufacturing imperfections.

Without limitation of the right of withdrawal, upon delivery of the product, the consumer, who has reason to believe that the product has been damaged during transport, must refuse delivery or accept it with express reservation.

Each collection of intact packages must be made by the customer by adding the words "INTACT PACKAGE, WITHDRAWAL SUBJECT TO CONTROL CONTENT" on the appropriate accompanying document (Article 1698 of the Civil Code).
Any anomaly must then be communicated within eight days in the following ways:
a. anticipating by e-mail to info@lastilograficamilano.it the report with all the references of the order and a copy of the receipt and the waybill signed with reserve and the photographic documentation of the damage;
b. by registered letter with return receipt to the following address:

Procedure for exercising the right of withdrawal To exercise the right of withdrawal it is necessary to send, within 10 working days of receipt of the purchased product, a communication in which the intention to withdraw from the purchase contract is clearly expressed.

The communication can be sent, within the same term, also by telegram (to the address indicated above), e-mail (info@lastilograficamilano.it) and fax (to the number 0229513436), provided that it is confirmed by registered letter with acknowledgment of receipt sent to the address indicated above within the following forty-eight hours.

In case of doubt, we advise you to contact us by calling the telephone number 02.29405604 (the service is active from Monday to Saturday from 09.30 to 19.00, except Monday morning).
The consumer must then provide, using a courier of his choice, the shipment of the product (in the original packaging and, in any case, always carefully packed) and complete with every accessory, instruction manuals and everything originally contained.

The consumer must make this shipment within ten working days from the date on which he sent the notice of exercise of the right of withdrawal.
Important notes The transport costs and the responsibility of the goods during shipment, as required by law, are borne by the consumer.
It is therefore advisable to insure the product with the chosen courier, taking care to carefully pack the goods, where possible by inserting the original packaging in an external box and, in any case, avoiding damaging the product with adhesive tapes, labels, etc. The product must be returned intact and complete with all its parts and accessories, including any guarantees, instructions, etc.

In case of transport damage occurred during the return, La Stilografica s.r.l. will communicate the damage to the consumer within five working days of receipt of the product, allowing the consumer to file a complaint with the courier used for transport.
The damaged goods will be made available for return and the request for withdrawal will be canceled at the same time.

Except as provided below for the case of partial withdrawal, La Stilografica s.r.l. will reimburse, within 30 days from the moment it became aware of the exercise of the right of withdrawal, the full amount of the purchase and transport costs for delivery, by cancellation procedure on the credit card or by bank transfer to the current account indicated by the consumer; The latter shall bear the transport costs for returning the product.

If the withdrawal is partial (ie concerns only a part of products delivered with a single delivery), the reimbursement of the shipping costs incurred by the consumer for the delivery of the products at the time of purchase is excluded.

Order Cancellation Request
1. The purchase order can be canceled in full if, at the time of the cancellation request, the shipment of the product is still being prepared and, in any case, if the amount has not yet been collected; In this case no cost will be charged to the customer.

2. If at the time of the request for cancellation of the purchase order the product is already entrusted to the courier or, in any case, the amount has been collected, the consumer must exercise the right of withdrawal and return the goods to La Stilografica .

To this end, it is necessary to follow the procedures indicated above for the exercise of the right of withdrawal.
